Sound like a carb float issue. The carb float bowl isn't filling with fuel fast enough to keep up with throttle- it'll idle nicely, but givie it gas and it dies.... The carb float should be level when the carb is upside-down.

What may I ask is the float ? Could this just be an adjustment issue ?

The float is the black plastic thing that you see in the pic. You'll have to take your carb out and pull the bowl off to get to it. Turn it upside down and it should be sitting parallel to the flat bowl base of the carb-- as seen in pics..... It's a simple 30 second fix if it isn't level- simply bend the little metal tab that attached to the plunger to adjust it.

could it also be an intake leak thats the cause of both issues?

I could be wrong but an intake leak would be a vacuum/air leak. Fuel shouldn't be able to leak out because there is vacuum. If there is a leak at the intake it would explain the dying part but not the liquid. Please correct me if I'm wrong.

OP: Cant hurt to check for air leaks if the float does nothing for you.

Hmm float seems good to me anyway. Spark plug. Intake leak I fixed (bit of liquid gasket) I do need a new intake manifold though I I have a minarelli engine so can I use any minarelli carb ? Think I might just but a new one (a new branded one from yamaha= €170 or I could get a cheap one off eBay for €17 plus p&p

You can have fuel leaking from a vacuum leak at the intake or in the cases. A while ago when my 110cc was leaking at the reeds I first noticed because of blue oil laced fuel residue in the area.
Only things that should be leaking around the intake would be fuel or oil unless you count air. Oil should be fairly obvious and fuel should smell like fuel or evaporate over time just leaving behind oil residue.
If you end up getting a new carb, I'd go with the knockoff. No way I'd pay 170 for a stock carb. I'd buy a Dellorto if I was inclinded to spend that kind of cash on a carb.

Thanks Brent. Yeah 170 euros is crazy for a carb.

This is kind of crazy but I did experience this last night while working on the 4t with old bad gas and nasty rusty tank- it wasn't a leak per se, but I was getting a lot of clear, non smelling liquid.. I'm assuming it was water moisture from the scoot sitting around? From the ethanol or whatever? I would drain the tank for a few mins then get good gas, hook the carb back up then get basically water coming into the fuel filter... I did this like 3 times before finally just pulling the tank...

Okay so the 2 stroke oil in the tank has been sitting their for about a year and a half I drained and put some new castrol power performance and the leak isn't as bad but. I went on a nice 20k ride today when I got off I did an inspection and the leak wasn't as bad I wiped it up with a rag out of curiosity and took a lighter to it and to my surprise it didn't catch fire so I don't think its oil or fuel. A dry day so its not water sparging up from the wheel... Any other suggestions ? I think I'll just buy a new carb...what size would you guys reccommend I can get a 16mm for €21 or a 19mm for maybe €60 ? What's the difference it let's in more air ? If I'm not mistaken I thought more air leaned out the fuel mixture which I thought killed your engine sooner ? Anyway now I'm running nice and rich for now until my parents can order me the new carb thanks guys

Oh and btw some carb adjustments along with throttle adjustments and choke adjustments it no longer cuts out.
