it seems like the oil fil port is clogged when i add oil it dont seem to go in the crankcase

Check that the valve cover vent tube is not kinked.
Additional context may be helpful . . brand new unmodified scooter?

If the oil is very cold, unsure of your climate, you’ll have to pour very slowly.

ty both of you the only mod is i took off airbox and replaced the carb im usieng a aftermartket filter

Well use flashlight and look inside the fill tube where the dipstick is you should be able to see if there's anything there.
did you drain old oil?

i stuck a wire in the dipstick hole and it went right thru no issues

What grade of oil you using 10W-40?
Did you drain old oil?

yep changed the oil and drained it useing 10/40 walmart systhnic

nah the new oil wont go in hect i even left funnel in and let is slowly go in. i get like a cup a oil in and the dipstick tube slowly goes into crankcase . but if i start it the oil goes back in dipstick tube even shoots a stream of oil out as i remove dipstick .. it is the weirdest thing i have ever seen

btw there was a vacumn line that went from the valve cover to the filterbox when i removed filter box i just pluged the line do you thnk this could be the issue?

Its crankcase ventilation hose not vacuum line dont plug it just leave hose hanging so it can vent while riding its important its normal if it throw bits of oil trough that hose. Does your oil flow okay out of the bottle or its thick like honey or wax try bring oil bottle home for an hour to warm it up to room temperature.
You probably need to drain more because if oil frozen in the bottle then inside engine is same thing you probably did not drain it all out of the engine, you should get about quart when you drain it.
