Step through would make it a scooter/moped in Kansass.
I imagine the frame is more substantial than most scooters under that plastic crap on the step through design shown.
If you have to swing your leg over it would be a motorcycle.

Over here in Holland the general rule is: Gears = moped (49,9cc) or motorcycle (50cc and up). Cvt = scooter (no matter the engine size). I can't think of any exeptions.

Personal classification... I'd probably call it a Noped. Moped without pedals. It's much more similar to a moped to me; just with some more scooter-like fairings on it. The large wheels are a lot of that. Even my 500cc TMAX scooter doesn't have wheels that large in diameter. There are scoots up to 16" wheels I know... maybe 17s, but they more clearly resemble a scoot to me with floorboards and such.
Honestly, much of the time that I mention riding to strangers I just call my scooters motorcycles. I found that when I say scooter these days, people think I'm on a standup scooter. If the convo gets more bike/detail oriented, then I clarify.
Legal is clear for that here. It's got two wheels and it's over 50cc so it's a motorcycle. Doesn't get broken down any more than that.

Ya got to love the lawmakers. They scratch their heads, then scratch their nuts or whatever, then make decrees like night is day, the moon shall not shine, and the Emperor is wearing new clothes. LOL It seems every state/region/province/country is different. Making classifications or putting anything in groups is not PC. Thingy is not correct...

Yeah anything 50cc here with or without gears is classed as a moped. Anything bigger is a motorcycle. But even the news outlets here now call any scooter a moped. Ever things like the Vespa GTS300.

The news outlets don't even know what an assault rifle is. Their judgements or pronouncements about anything can not be trusted. They just spit out wild sound bites for click bait. A sentient person must read carefully and compare information from many sources. 99% of the information out there is false.
