Bad news everyone! I just got out of jail Saturday and havent had the chance to type about it until now! I was riding Saturday with a friend and my uncle when we were all pulled over for speeding. We got clocked at 43 in a 40! Buuuut since the cop was a total :censored: on a rampage he gave us the whole bit! Of course i didnt get to hear much of it because i was taken to jail for being a habitual traffic violator and riding a scooter to fast. I guess no more than 25mph is the law around here and they are cracking down they said. Cost me $500 to get out, and gotta go pay whatever else more to get Skeedr outta impound  ! Im facing a D felony for riding my scooter  ! Im still in shock over it all! Im not sure what to do right now! This couldnt have come at a worse time for me, im broke right now and have to hire a good attorney for this. I really dont know what else to say right now, im still pretty upset. They say as soon as my scooter went over 25mph it became a motorcycle :stumped: |

Man that is harsh! Will be praying for a good result for you. For now all you can do is be with your family and get comfort from that. The rest will work out one step at a time.

Thank you Tim  . I will do whatever i can....Looks like the Ape is gonna be up for sale as soon as i replace the starter ! I hate to sell it but its looking that way now. I went out this morning to go over to Uncles and talk with him about all this BS and the starter went :banghead: ! At least it quit at home i guess  . Gotta go :barf: |

That's bullshit man! I blame the economy. The cities and counties are all broke so they're slamming fines on people for the cheesiest stuff. Legalized extortion... I hope it all works out for you. I always opt for community service rather than pay a fine if I can or I stretch out the payments over many, many months. As long as you make some sort of token payment they can't arrest you. ;D I may have a used starter. Send me a pic of your old one. If the one in the pic below is a matching one I'll send it to you for the price of the shipping.  |

Wow, that is harsh. They don't usualy go after the scooters for the over 30 thing, in your case over 25. But yea, they always take payment plans, as long as you try they don't want to jail you. Costs money.

Damn, Robert. Horrible news. I'm sorry to hear about it. Are you on a suspended license? $500 bail? That would mean your bond was at $5,000(?), which means they are pretty serious about it. Did you have to talk to the magistrate?
So the deal is if you go over 25 mph it's consider a motorcycle? Does that mean you can ride it under 25 without a problem? Did he say anything about the mods or anything like that?
How's the wife feel about the whole situation? I hope she's not against scooters now. I'm really sorry to hear about this man. Legal situations can put a huge amount of stress on an individual, or family. You'll get through it, and eventually, it will all just be a story you hate to tell. Good luck my friend. That really sucks!! :swear: I guess there were no "real" crimes being committed. It seems like they should out harassing real criminals who are actually harming society, instead of hassling people riding Scooters. :scoot:

Like Fox said,all the local govt agencies are broke and the cops have been asked to generate income with BS tickets!Its happening all over the country.Mean while our local sherriff and 12 officers were busted with drug trafficing,now who's the criminals??
Sorry that happened Robert,all you can do is fight it by using the 'system' and hiring a lawyer,maybe he can get you off by some technicality...

Run! move to south Korea and open a great tuning shop. You'll have all the business you can handle. Of course you'll also have to work like, welding 1foot extensions onto the shocks of a crotch rockets, and installing more flashing lights than the set of "Price is Right."
I'm scared to move home. I am a habitual traffic violator too. Korea has just made it worst, now I have even less respect for laws.
This totally sucks. I'm scared to move home, but I don't want to stay here.
I'm sorry that you went to jail. Next time try telling them that you have declared your property a sovereign nation and you are the king. When you leave the property you move with diplomatic immunity.
Then at least they won't take you to jail, they'll take you to the hospital.

I was surprised at what you said about 25 mph so I looked up the Indiana scooter laws. It is stated you "Cannot go over 25 mph" That is the worst rule I have seen. Seriously scooter are generally restricted to ride about 30 mph 25 is stupidly slow. I have seen that police generally are not completely aware of local scooter laws. In your case they seem to have real focus on them. That does imply they have decided to crack down.

My States law says this:
"You must be age 16 or older to operate a moped on North Carolina highways or public vehicular areas. A driver license is not required, and the moped does not have to be registered, inspected or covered by liability insurance. A motorcycle safety helmet is required by law when operating a moped on North Carolina highways. A moped cannot have a motor of more than 50 cubic centimeters, an external shifting device or have the capability of exceeding 30 miles per hour on a level surface. "
There is a difference in the wording. Indiana's laws say if you go 25.1 mph you are in violation. My states laws have some wiggle room. "a flat surface" implies one may, on ocassion, travel over 30 mph, say down hill.

Just called the impound and they are making it a tuff as possible for me to get Skeedr back! I gotta go to the Police station and get a release first, then go to the tow yard and pay $150 to get him out. I dont have it so im trying to gather up some stuff for the pawn shop  . The lady at the impound sounded ok so i was sweet talkin her..She told they were chalk full of mopeds and scooters from this weekend! The cops told me they were briefed told more about moped laws and told to crack down on em ! Whatever, thats fine, do yer thing piglets. BUT dam, im just a 30 recovering alcoholic that has been trying to do right by the law! They got all hard and ready when they saw us riding, then they got nervous when they realized we werent drunk, drinking, nor had drugs, and nope sorry oscifer we werent high on drugs either  !!!! "aaa, i got it!" The fat old cop says! "This one here on the cool blue scooter is HTV, lets nail his ass for riding his moped"! Stupid F$CKS!!! And they wonder why people give up and just flat out go postal on their asses  ! I feel like driving Skeedr straight up their asses at 12-o-clock when i get him out of impound  . Only thing they got going there is the fact that i love my scooter so much and wouldnd put Skeedr through any more trauma. My license is right there on the line of being taken for life drawk. Im on a ten year suspension right now, and after what happened Saturday im facing getting them taken for life ! I didnt talk to the judge, i bailed out because the jail was so full i had a feeling it would be awhile...Everytime i end up in county jail it seems they purposely put me with some punk, or punks and i get another charge for battery ! They do that shit on purpose too! Saturday i asked nicely to be put in a cell by myself or with  . Nope, not so! I think they get a kick out of it or some shit? Flat out get off on it! Sick bastards! Put me in a cell with a mouthy drunk! Yep, $500 down the drain! D felony guys and gals! Im looking at prison time for scootin    . As long as its under 25 it wont transform into a motorcycle is what they say! They let my friend and uncle go with tickets and told them not to go over 25. My buddy said he was so nervous he didnt even go over 20 on my Ape all the way home. Im not risking it anymore tho! Skeedr,s just gonna have to sit for awhile . Im thinking of getting my Tomos up here from my Pops and getting it cleaned up and running? It looks more mopedish and slower. My wife is still all for the scoots man, its the messed up laws they keep bending and changing literally while im riding down the road that pisses her off! Shes great man! I wouldnt be sitting here typing this w/out her love and help ! I would still be in jail banging a head against the wall or talking my way out of another charge by now  . I honestly feel they could have just ran our ID,s, checked us for being under the influence, then once they realized we are just a few guys enjoying a nice day on our scoots, they should have just let us go on a warning or maybe a speeding ticket............. |
