Ya I am trying to figure out how they are going to get him for driving while impaired. If he didn't do any property damage and they didn't see him riding it drunk I find it hard to believe they can charge him with anything other than public intoxication. Now if he would have hit another car or did some property damage and there was a witness he would be screwed.
I say at least talk to a lawyer, they will normally do a consult for free. If they can't help you they will say so. I talked to one when I had to go to court for my child support. His advice was give them the money I would have spent on him and see how it played out.
I gave them the money AND went to jail for 45 days, which cost me 1700 dollars to go to jail. Makes perfect sense considering I had no income. I guess its illegal to be poor in Michigan.

Disclaimer: I'm not a lawyer.
You could easily get out of this.

I set a bull-dozer on fire when I was 18. It was my birthday and I was really drunk and thought it would be funny. $90,000 piece of equipment. Needless to say, I spent some time in jail. You would probably not be surprised at how many people were there because of child support. Catch 22: They could get out if they paid, but had no job or income in jail. The more time they spent there, the more money they owed. So more time was served to account for it. Maximum time was 120 days and apparently, after that, you had a month to pay your balance or you'd be coming back.
They have since changed this. No negative balance can be accrued while incarcerated. Our lawmakers really think things out.
I was arrested a year ago for not paying child support that I had receipts PROVING I paid. I showed the arresting officer the receipts and he says "I believe you man. Unfortunately there's nothing I can do for you. If I was you I would get a lawyer." So I took his advice. The lawyer had me released 4 days later. Gotta love bureaucracy. I sued the Department of Social Services for the time I spent in jail missing work (and then some) and won. Apparently they have a bunch of incompetent employees who don't do their jobs correctly. I used the money to pay the lawyer and 4 months of CS.

I think more people would admit these things if others would stop with the judgement. Wallyeye1963 is already being critical of himself. Therefore, others don't have to do it for him.

Walleye I commend you for your honesty. I do think that drunk driving is completely irresponsible though. Anytime my wife and I go out and we know we're going to have a few, we take a cab. They drop us off, and pick us back up. That way we can actually enjoy ourselves without worrying about killing ourselves, someone else, or going to jail. We've been doing that for years. I'd rather pay $20-$30 for the cab ride there and back, than thousands..
Not ragging on you though. Sounds like you're beating yourself up pretty well over this..

I was busted for 2 duis in less than six months of each other, lost my Lexus that I had just paid off to the state (at the time I didn't know they could do that), am paying a total of 1500 dollars in fines on top of 2800 dollars in lawyer fees, plus god knows how much in fees to get my license reinstated when my suspension is up to get the chance to apply for a restricted license. Since then I came to terms with my drinking problem, went to a rehab, tried aa, quit aa, and have still been sober for more than 13 months. Walleye, we all make our own decisions in life, good and bad. I don't judge. I've been judged, as will you, and I'm glad you've publicly admitted your mistake. In the end, I hope that you've learned from this experience, if you need help that you find it, and that you make the best of this situation. If you ever need any advice, or just an ear to listen, pm me. I'd be glad to share war stories and maybe a bit of knowledge I've accrued. Carry on safely!
