Many state laws require scooters to have automatic twist and go transmissions. That makes anything with a clutch or gears a motorcycle. Yeah, but 50cc and larger is considered a motorcycle anyway so might as well give it a manual. Michigan now allows up to 100cc as a scooter. Must have automatic transmission (no gear shifting, twist & go) to be a scooter, otherwise it's a motorcycle.

If we're talking 49cc I don't see why you'd want gears. Tune the variator. I've ridden a kitted Derbi with a perfectly tuned variator and its amazing. My kitted Chinese pos with stock drive on the other hand leaves much to be desired.

Kansas allows 130cc for a moped. So if I lived in Kansas I could.legally ride a 130cc bike with no registration? Wild. A 130coc 2t can be quite fast. Ahh... 30mph limit still... I guess this allows Briggs type.minibikes to be street legal? moped2.org/laws/Kansas.htmAnd a 3.5HP limit which kind of eliminates a 2T, unless they don't know about it... }:> I intend to run a 125cc 4T with rear gearing like a 50cc which should keep my speed down but allow power for the hills. Variators on these scoot engines still suck big time.

So the desire is to lock in low ratio for hills, correct? Anyone building any sort of after market launch lever type arrangement to fit any of the more common cvt units? yeah, come to think of it, if it has manual shift with manual clutch, I suppose it would "officially" be a motorcycle (and we don't need them here... heh).
But they do make "automatic" tranny motorcycles... they just have clutch levers.

Not that mine is actually 49cc anymore..

The lines of what is a motorcycle or scooter are kind of blurred by viewpoint. One of the GY6 scooters or Burgman or Silverwing or 200cc Vespa etc... are clearly scooters to me, unless you look at it legally and then they are motorcycles. With the way some state laws work, it can relate a bit to Back To The Future. There the DeLorean could hit 88MPH and change to a different time. In the case of a scooter in some states, as soon as you hit xMPH it instantaneously transforms into a motorcycle as far as the law is concerned.

Kansas inserts the words 'except in low power cycles' into their 30MPH rule. It means speeds over 30MPH are OK when going down hill or with a tail wind...
