Georgia law says 50cc, 30mph max, no shifting gears so it could be a "moped" under Ga law. We all know the manufactures/dealers are disingenuous about the actual speed these things will do.

I've looked at one of those in person. It's a 139qmb engine in a motorcycle frame. All that front plastic under the tank is empty.
I'm waiting to find a busted up one for cheap I can strip to the frame and cut off all the extraneous mounting tabs. It'd look kind of like some of the race scooter frames without the fascade.

Billy Same in MO but because of its 'looks' be prepared to be stooped alot due to lack of tags and when the cops doint get that on you, they might look real hard for anything else. Doint forget to leave for work 1/2 hour every day. That bike is just bad Karma.

Some states ( like KY ) require it to be a step through frame, before it can be considered a scooter. Good luck.
I agree, riding that is begging cops to stop you.

MD requires a step through frame. Well before registration laws here, friends and I were pulled over on a little smaller versions of those (different engines) on more than one occasion. Cops didn't seem to like them at all, probably because they were illegal and the MVA's site used to clearly point out the lack of step through frame as not being a moped/scooter.
It may actually be easier on you now though, with registration laws. If the paperwork looks like a scooter, the MVA should issue you a sticker. Once you have a sticker for it, I can imagine you getting pulled over, but I'm not sure what they could really do at that point. It would have to be a great deal for me to want to buy something like that though, because it's hard to know for certain how things will go with the MVA.

I didnt know there were places where the shape matters. Most states don't care, otherwise the toptank mopeds wouldn't pass.

Up here a scooter is defined as gas powered, have a “step-through design” and automatic transmission. Everything else is a Motorcycle even that little thing.

In Kentucky, all top tank " scooters" are legally motorcycles. Even the old pedal power mopeds are considered an off road purpose vehicle, and must meet a laundry list of requirements in order to be Street legal, and then as a low powered motorcycle, not a scooter.
Only a step through frame can be called a scooter, no matter engine size.

Law in Iowa is about as simple as it can get.Must not be capable of speeds over 30mph.Taken literally you could restrict a Hyabusa to 30 and be amoped.In reality when you take your MSO to the DMV they decide for you.My 49cc Z50 was titled as a motorcycle as new so it'll remain a motorcycle.But you can change gears through the "auto clutch system.Gotta plate either and the plates are the same be it scooter or m/c.However m/c plates are more expensive.Gotta love our law makers.
