They won't go any faster, they just look like they will. It's still just a 50cc bike. Over 50cc means it needs motorcycle registration in GA. Requiring shifting or a user-operated clutch disqualifies it from being a scooter/moped there as well. Some states even require step-through design, but it doesn't look like that's an issue in GA.
With those in mind, the first one should be fine if you want a motorcycle look with 49cc scooter power. The second one will require registration as a motorcycle, insurance, and a motorcycle license to operate legally.

This isn't a highway bike? You need 250cc or more to legally ride on state highways.
