the bushing on the kick start lever is shot, or maybe the spring has com off and unwound. does it return on its own after being kicked?

The kick start lever attaches to a shaft that has an 'arc' shaped gear. If that gear is not meshed with the other gear properly, such that the arc is rotated a bit more CounterClockWise than the first teeth, it will not retract properly. There is a 'solid' section along the arc gear that is not readily visible, you have to look for it. The gears must be meshed 'after' that point. Rotate the arc gear a bit further counter clock wise when meshing with the gear that gets pushed out against the variator hub. The other possible cause is that the return spring is jammed. It should be 'down' around the metal that the arc gear shaft rotates within. You should install the spring, then install the gear & shaft, put on the washer and snap ring, and the kick start lever. THEN, use some pliers to pull the spring around to where it grabs onto the arc gear. The remainder of the spring cannot get caught by the gear if installed in this order. Remember there is also a plastic 'ring' that should be installed onto the boss that the spring wraps around. If missing, the spring may be able to sneak up under the gear and cause trouble. Do the teeth mesh freely when you crank the engine using the kick starter? You can do it slowly, and feel how well they mesh. If they jam up, you may need to replace the gearset. tom

I had the same issue with my 2011 Toa Toa. The snap ring had fatiqued and slipped out of it groove in the shaft going thru the CVT cover and allowed that shaft to move around a little bit freely.
