Well I did read it about five times and what I took away from it was "No seat, 30MPH or less, 3 or less wheels = motorized scooter which is a stand up board scooter with an engine on it.
It goes on to say: If your moped exceeds these definitions then it's classified as a motorcycle and subject to a different set of rules. (Not a motorized scooter, it's a motorcycle)
Same here in Calif. A 139QMB powered scooter is treated the same as a Kawasaki 1000. Same lic and insurance requirements, but no speed limit.

the statute image you posted has defintions for titling and registration purposes only and 50cc scooters would fall under motorcycles for titling and registration, which makes sense because mine is registered as a motorcycle (albeit with "body style" MS for motorscooter, but I don't think that is used for anything)

You know what- I think u guys are right on this one-my apologies. Hey- I can admit when I'm wrong haha. I just spent like 20 mins going through FL statutes and it's quite confusing- since they're considered motor scooters not defined by any statutes they're considered a motorcycle (not motorized scooters or mopeds)- just like you said. No speed limit. Sonofabitch I had a police officer tell me I cannot exceed 30mph- just goes to show how much confusion there is when driving an undefined vehicle. Well I guess I'll just keep doing what I'm doing!

If you do somehow get a ticket for going over 30mph just fight it and you will win no doubt, there's no where in the statutes where you are breaking the law so they can't write you a ticket. Also gotta be careful with the statutes because the "definitions" change for 3 different sections: register/titling road rules licensing all are 3 different chapters and when they say "motorcycle" or "scooter" etc. they can mean different things depending on which chapter they are in. each chapter has a definition section for definitions used within the chapter.

I learned all sorts of crazy stuff reading these FL statutes- like anyone under 21 MUST wear a helmet. You have to have $10,000 worth of insurance coverage to ride without a helmet, mopeds must be registered but do not require titles (interesting purchasing options there). Anyone under 21 is not supposed to operate a motor scooter between the hours of 1am and 5am unless they are travelling to or from work... even more crazy stuff!

Yeah same here in Cali. Some cops and even some DMV employees are confused about the definitions. I see scooters like ours with moped plates on them sometimes which is cool because here a "moped" or motorized bicycle is registered but the fee is a one time only fee that is good for life and you don't need any type of license at all.
If you have an electric scooter that looks like ours do with full plastic body and seat you don't need a license

Check the actual state statutes. The DMV and many law enforcement agencies LIE like to gain additional revenue and 'control'.
