WI, drivers license required, helmet not required, under 30mph, no passengers. Looks like all you can do is get the Lawyer, and let him do his job. I have some spare GY6 stuff, starter, relay, CDI, coil, PM if you need.

What scooterists there in Lafayette need to do is make the law work for them. Since 25 mph is ridiculously slow everybody on a scooter needs to drive 25 or slower, two wide or as far in the left of their lane as possible holding up traffic and enraging motorists. Scooterists would have to put up with a lot of rude language and gesturing but they have a right to be on the road, nonetheless. Soon residents would be complaining to their aldermen and the Mayor who is the boss of the Cheif of Police and enforcement of this stupid law would end.

Soon residents would be complaining to their aldermen and the Mayor who is the boss of the Chief of Police and enforcement of this stupid law would end. I feel that's a long shot at best. Instead of relaxing the law I think they would go they other way and ban all the 50cc scooters.

They'd probably make it so 49cc scoots could only travel on the shoulder unless the posted speed limit is 25MPH or less. Then they may ban them from roads with speed limits above 25MPH with no shoulders.
We had something similar proposes around here last year. It even said in the local newspaper that the reason was complaints from motorists about scooters slowing down traffic. Our law is 30MPH and as it stands we must ride on the shoulder if the speed limit is above 30MPH. We are allowed on roads with no shoulders, but we have to yield to faster traffic. After the angry motorists they decided it would be best to just ban scooters from roads with no shoulder and speed limits above 30MPH. I wrote to my representatives and explained that out here in the country half the roads are 45MPH speed limit with no shoulders. Passing a law like that would essentially ban all scooters from being useful in areas like mine and there are folks around here that need their scooters to get to work. I kept in touch with my representative and so far the bill hasn't passed. Not saying it's my doing that it didn't pass, but if you are concerned about laws like this DO NOT sit back and assume someone else is speaking up. Most people just take it and never say a word to anyone with power. Even if it does nothing, it won't hurt to speak to your representatives.
Anyway, as I said to you earlier, I'm sorry about all of this and wish you the best of luck throughout the legal process. I know lawyers are expensive and you've got $650 just in bail and impound fees. Get that PayPal account setup and give us a donate link so anyone that wants to can help out a little.

Thanks again for the info, help and support everybody ! It means soo much right now! I am in the process (one thing at a time here) of 1. Getting Skeedr out today! 2. Setting up an apt. with a lawyer! 3.Getting a petition of some sort written so i can start getting it signed. 4. Getting a new Paypal account set up (needed to do that for too long anyhow) so i have one and any help would be great ;D! I hate to even ask but im down :crash: . And 5.Getting the Tomos up here and running smooth to drive daily until this whole moped/scooter deal settles, or we move out of this county . I went out and took pics of my Aprilia (Ducati) starter and am putting them in the Ape build thread. Thanks Goosey and Fox for the offer but im not sure they will fit. I have a GY6 starter too but im not sure yet! We will see soon, thank you so much!

I have some spare GY6 stuff, starter, relay, CDI, coil, PM if you need. If that's really the law, then I've been driving illegally the whole time. I thought you only needed your temps. I never bothered getting my full license because I don't plan on driving a car anytime soon.

My God, man! What a nightmare...really sorry for your circumstances. Cops+power scare the hell out of me along with government, from local to federal. Sometimes it's hard to get a break no matter how hard you try to do the right thing; I'm clean and sober 13 years but sometimes shit still happens! I'm thinking good things for ya ...

...Skeedr,s just gonna have to sit for awhile . Im thinking of getting my Tomos up here from my Pops and getting it cleaned up and running? It looks more mopedish and slower. ............. this is something I have thought about before. If a scooter looks like something more than a 50cc it is probably likely to get one hasseled more. My 4 stroke I had before this was a big 150cc sized scooter. I was always concerned about attracting attention. Now my 2 stroke looks like a motorcycle from the front. That plus the 2 stroke sound is an attention getter. I am so concerened about it I signal in the grocery store parking lot just in case. Last week a police car followed me out of the parking lot and down a couple of blocks before he turned off. I really thought I was going to get questioned about my scooter.

I think the 2T sound is a plus. Most don't expect a 2 stroke to be a motorcycle sized engine.

Good news and bad news folks! First with the good! I GOT SKEEDR BACK!!!! ;D :scared: :spin:  :thumb:  :burnout:   :checkered: :jaw: :welcome: :stars:  :scoot: :scoot2: :riding: ! Im sooo happy to have him home safe and sound w/out any damage! On to the bad part! I had to sign Skeedr,s life away from the streets of Lafayette Indiana for ever! It was the only way to get him back and i barely was able to talk Sargent Smith into that. He wanted me to go get plates, insurance, a valid M/C D/L to get him. I kept my cool and told myself, "come on brain this is your only shot!". I said to him, "you see officer Smith, im sure you know by now that my DL record is very bad from the past. I have been doing my best to comply with all the laws i am aware of. That is why i bought the scooter to begin with. If you could kindly explain to me, even better give me copies of the current MOPED (motorized bicycle) laws i can get the one i need to have and comply fully to the law. The thing is, i simply cant afford to purchase another MOPED( i hated calling Skeedr a MOPED but i had to down there) so i really need the CPI so i can sell it and get the right kind. Can you help me please?" He loved that talk ! I had to write up my own letter stating that Skeedr and his SS# will never hit the Lafayette public again ! AT THIS POINT IT WAS THE ONLY WAY! I went down with my release form and my $155. The employees at the impound said, "this is a first". I said, "whats that?". Them, "they never let ANYONE just push em outta here with the keys"! I said, "thats what it says right?" Them, 'yep, follow me'. We went out to the yard and walked about an 8th mile to a pack of about 15 scooters all in the weeds, and it poured last night! I spotted Skeedr right away and went over and started inspecting....Thank you! Everything is here and appears to be ok! I ask the guy in a cool tone, 'you guys fire this puppy up? shes mean!' . I was trying to get him to confess by sounding like i was cool with it. He said, 'no we cant do that, against policy' lol we save that for the Harley,s' I said, 'cool, those suit you better anyhow as i smiled and fired Skeedr up to make sure the engine sounded ok before i left the lot. He looked awful close when i popped the seat to pull the choke for a guy that cant start em because its against the policy  . Skeedr fired up and sounded good! Thank you everything good again ! He was looking at me like, "you cant do that" so i shut Skeedr back off and pushed him the 5-6miles home with a smile the whole way! I even had a ride for him in the back of a crazy ladies pick-up(she was getting one outta impound too) but i said, 'no thanks, im not letting go of these bars until the scoots in my garage with smoke rolling off the back tire  !!!!! So thats what i did, pushed him all the way home. Fired him up to warm when i got to my block. Got to the garage and filled the whole thing with smoke :riding: ! I can do it again and get some vid this time ! Hell its the only place i can ride it around here anymore. Might as well enjoy it :thumb: . Next is setting up an apt with my lawyer for all this! I was thinking a type of petition is in order here. Im gonna speak with the lawyer but i was thinking something along the lines of " if you feel the current MAX speed law of 25mph is dangerously slow please sign and comment if you would!". Then just go and have a blue bazzilllion peeps sign it and comment. Cant hurt! they had a big two page deal in the paper Sunday all about scooters and how they are cracking down. They had a rant and comment section. I was surprised at all the motorist that dont ride scooters but still would really like to see them go faster than 25 legally because it causes so much congestion that its MORE dangerous than it would be if they were aloud to go along with traffic. I found out from Sargent Smith that it is also illegal in Indiana for ANY moped/scooter dealer to sell a scooter or MOPED that has over 2HP and will go faster than 25MPH. Its even illegal for me to sell Skeedr the way it is, even if it was totally stock it would still go over 25 so i cant sell it. I was told of many dealers that are in "hot water" as we type over this BS. Almost all the dealerships here, the guy i bought Skeedr from is on the list. Another is Camel Turd aka Beyond The Limits is on the list too. He is the asshole that pretty much accused me of riding a stolen scooter when i first bought Skeedr and stopped by his wannabe shop for a few things. Im not on the list tho! Its because i only repair them. I CAN sell them, but they must be in full compliance with the law and MUST be used, i cant sell any brand new scooters without the proper paperwork! Hell, a used carlot cant even legally sell a new scooter unless they are licensed to sell NEW cars as well. Bottom line! WHAT a F%CKIN MESS THIS IS ! More good news at the Ape build thread !

I think the cop is wrong about it being illegal for you to sell it. They can't dictate to you what you can own or sell. If the scooter is used for off-road purposes only then there's nothing they can do about it if it goes 100 mph. Besides that you can sell it for whatever and write up the paperwork like it was a gift you gave away for free and there's nothing they can do about it short of giving you and the buyer a polygraph test if it's a cash sale.
The cops act like they are in control but it's really all up to the judge and the D.A. The cops don't make policy and they don't decide your punishment. It's in your best interest to be cool to the cops because they can persuade the D.A. and lie to do so but in the end the judge will determine your fate so start getting your story straight. Judges just wanna hear you own up to your part in whatever the issue is and that you are very sorry blah blah blah. If you get a good lawyer then they can get the charges reduced most likely. The D.A. wants a "win" and they'll take a plea deal to get it every time if it means their batting average goes up so you'll probably end up with a misdemeanor. I've always gone into court expecting the worst and 100% of the time I get less than the worst.

Yea, your right Fox. I had to 'play the game' to get my scooter back for now. I have copies of the paper work I wrote up FOR Sargent Smith regarding the BS about riding and selling Skeedr. I thought about arguing the fact that Skeedr could be used for offroad use and so on but i knew it would be better for me to jump through the hoops for now and let the attorney do the talking later. It sucked but i had to do what i had to do. Unfortunately i have been down this road before, just not with scooters. So i know what to look forward to at court . I could take a plea and might have to? But of course im hoping with all the technicalities a good day in court might get the charges dropped? Haha, wishful thinking i know, thats how i gotta think right now tho, facing prison time and all
