We has found gas in the oil, what would cause this? ?

First, are you posting in the correct section (is it indeed a two-stroke)? For a two-stroke to have gas in the oil someone would pretty much have had to have put it there, like filled the wrong tank. If you've got oil in the gas of a two-stroke, it's probably just pre-mixed. Very common. If it's a four-stroke, either it's running incredibly rich and washing down the cylinder walls or the float has stuck and flooded out the engine.

I bought this scooter for my sister, and the only thing i could find out was she ran it off into a ditch to avoid some people it the road! The scooter was transported in a truck laying out on it's side. The oil was changed out but the oil still smells of fuel! This scooter would be a 4-cycle

OK, moved to the appropriate section.
No fuel leaks around it now? Runs OK? It doesn't surprise me to have fuel in there from it being turned over, but if it's still got gas in it after a change there may be a problem. Is it thinning out the oil and is it a very strong smell or faint now? Maybe it's just a lingering smell if it's faint and not thinning the oil. Maybe the fuel petcock failed and fuel is coming through a vacuum line into the engine?

it's normal for _some_ fuel to get into the oil over the course of an oil change interval, its one of the reasons motor oils have dispersant in them. oil reeking of fuel would indicate an overly rich situation, like 90GT said, and maybe worn rings allowing a lot of wash into the oil.
it could be that the scooter sat for awhile in an awkward position? (laid on its side maybe) and the fuel drained down from the carb thru the intake, and then drained into the crankcase that way.
i would give it a good oil change, and keep an eye on the oil after that. some fuel in oil at a normal change interval is normal, but generally not enough to really grab your attention (not enough to smell like gas fumes)
the possibility of a failed petcock draining fuel into the engine via the vacuum line is something to check/or just replace the vacuum actuated one with a manual petcock (common)

Thanks for the good info., it really helps !!!!!! THE scooter was transported on it's side after it had a impact with a ditch.
