Hello my friends,
I purchased a 50cc MC-08-50B from Hollywoods Cycles (now motodealerimport) /Goldenvale Inc/Roketa.com on 5/6/2011. now going by Mountain Top ATV's Conyers GA.
Scooter arrived last Thursday with quite a bit of paint damage from a broken metal crate vertical brace. I refused to accept the scooter so the driver said no problem, actually he is the one that suggested I inspect it before he left.
I bought this scooter to resell, and it would have been impossible to sell in that condition.
Hollywoods Cycles sent me the following message:
"Jason below are pictures of the scooter, Why did you refuse the scooter, the pictures show a few scratches which we can send you the parts to replace them... We did not even charge you the full $600 for the bike, we sent you the bike for $558, so why refuse, if it comes back to our wareshouse with this minor damage the freight company will not allow a refund of all the freight fees. please call Debbie below so she can bring the scooter back to you.... or call our office with the issue 1-800-520-9811 ext 213 Linda thank you"
And my reply:
"The scooter arrived with the right side heavily damaged from being picked up with a forklift while NOT on a pallet. The vertical brace shown below by the red arrow is broken away from the bottom horizontal frame. The vertical brace was then left hanging and rubbed through the paint on the right side quite badly. Again, the damage was caused from a forklift being used while not on a pallet. The photo shows only the left side and also it clearly shows the bike not on a pallet. Also, photos that small and at such low resolution do not show the extent of the damage and I feel the freight company does not WANT to show the full extent of the damage as they are only showing the left side and that’s not where the majority of the damage is.
I certainly appreciate the $42 discount but it was never discussed or agreed to. Was this bike discounted because it was damaged to start with? If it was, I was not made aware of this prior to purchase. Replacement parts on this much damage will be both left and right side lower fairing panels and the front fairing too. This will incur quite a bit more labor on my end.
Please send either another bike or a full refund.

I am not going to post the entire back-and-forth emails. I called this Linda person and whoever answered the phone could barely speak English. Anyway, they basically said while they realize that the damage was caused by the freight company, they will still take the shipping fees out of MY refund.
huh? yep thats right. Even though the damage was caused by the freight company, they intend to still charge me for sending it back. I should have never done this outside of ebay as now I have no recourse and they can do what they want.

If you ever see a big discount on an ebay item if you call in and use a CC, DONT DO IT. They can now do as they please and I cannot affect their feedback in any way, and cannot use paypal to get my full refund back. Crooks!
