If it's dry most likely the issue is with the carb or fuel system. Something clogged or a line pinched maybe. I'd think you'd have at least some brief indication if it were running out of fuel, but there are some things that are reasonably quick and rule things out or give you info quickly that are good to start troubleshooting with. Spark presence/quality, fuel on plug, and compression tests are usually good initial checks that will start putting you on the right track.

Ok found the wrench.
E started. removed plug. not wet.
removed carb inspected and I want to say the bowl wasn't as full of gas as it should be.
float needle was stuck up, possibly blocking fuel. could be the culprit.
carb bowl also had some gunk sitting at the bottom and idle jet was kind of blocked.
cleared out idle jet and cleaned the carb bowl. waiting for it to dry and will reassemble and see if that did it.
Oh I also changed to a 100 main jet from 95 just to be safe.
On a side note I think that stretch of road is bad luck. I broke down at the other end of it when the float needle got stuck open and it just kept leaking fuel. Now it's stuck closed haha.

Got the carb back on tried firing it up... nothing, same thing as before. checked plug, wasn't wet. tapped the carb incase the float needle got stuck again but still nothing. pulled off the shroud: part of the head melted against the cooling shroud. I have no idea if they are touching or if it was overheating or what. rest of the cylinder on the outside looked good I guess I will remove the head and inspect the cylinder. the head gasket is metal so it can be reused, right?

Yep HG can be reused,we like a shot of coppercoat to make sure it seals..

Have you tried a shot of fuel right into the cylinder? Whenever I have a bike that refuses to start I'll pull the plug and use a straw to get a bit of fuel in there.

Took off the head. Does this look alright? Now I think it did seize, looks like I got 4 corners going on (some term like that?) so now what are my options.

Shouldn't your head have the fins facing the other way, horizontal for cooling from fan??

The exhaust port faces down, and since you have your pipe hooked to it.... EDIT: My bad, he said the head. Will the stud spacing let it be mounted sideways? I've never tried.

Pull the cylinder off so you can see what it looks like all the way through and to see those rings.
It does look like a seize though.

It seems to me thats the way it fits best (I matched the pattern of the head gasket to the cylinder and also the extra space on the sides) I'll pull the cylinder off then.

Yeah, I scrolled back up after thinking about it. It is sorta strange that the fins sit that way instead of horizontal.

I'd put the head on so the fins are horizontal if possible. Otherwise air from the fan would hit a wall and move around the head instead of more easily passing through the fins and making the greatest use of the surface area.
